This page sets out the limits of our liability and your indemnity obligations when you use clearancewarehouse.net.au or buy from Clearance Warehouse Australia, a division of BuyFactory Direct Pty Ltd ("we", "us" or "our"). It forms part of our Terms & Conditions.

Your consumer rights come first

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing on this page excludes, restricts or changes any right or remedy you have under that law, or our liability for death or personal injury caused by negligence, or for fraud. Where those rights apply, they take priority over anything here.

Limitation of our liability

Subject to the section above, and to the extent the law allows:

• we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill, that was not reasonably foreseeable;
• we are not liable for loss or damage caused by misuse of a product, by not following the supplier's instructions, or by normal wear and tear.

Website availability

We try to keep the site available and working, but we do not promise uninterrupted or error-free access. We may suspend or change all or part of the site without notice.

Your indemnity

You agree to cover any reasonable losses, costs and claims we incur because you breached our Terms & Conditions, misused the site, or infringed another person's rights through your use of the site.
