These Terms & Conditions govern your use of clearancewarehouse.net.au and any purchase you make from Clearance Warehouse Australia, a division of BuyFactory Direct Pty Ltd ("we", "us" or "our"). By using our website or placing an order, you agree to these terms. Please read them carefully.

Use of the website

You may use our website for lawful purposes only. By accessing the site you agree that you will not:

• use the site in any way that breaches applicable laws or regulations;
• attempt to gain unauthorised access to our systems, or interfere with the site's operation or security;
• copy, reproduce or redistribute our content (text, images, branding and design) without our written permission;
• submit false information or impersonate any person or business.

All content on this website, including the Clearance Warehouse name, logo, product imagery and copy, is ours or our licensors' and is protected by intellectual property laws.

Products and descriptions

We sell new clearance stock and take care to describe each product accurately, including materials and dimensions. Photos are for illustration, and colours can look different on different screens. Where a supplier does not publish a specification, the product page says so rather than guessing one.

Pricing

All prices are in Australian dollars and include GST. We make every effort to show the right price. If we find a pricing error in an order you have placed, we will contact you to confirm whether you want to go ahead at the correct price before we dispatch.

Ordering

• Order processing. Once payment has cleared, standard orders are dispatched within 2 working days and express orders within 1 working day.
• Contacting us. You can email us at any time, and we reply as soon as we can, usually within one working day.
• Delivery. Costs and times are set out on our shipping page.

Orders and purchase terms

• Placing an order is an offer to buy. A contract is formed once we confirm and dispatch your order.
• We may refuse or cancel an order, for example where stock is unavailable or where we suspect fraud. If we cancel an order you have paid for, we refund you in full.
• You are responsible for giving us accurate delivery and contact details.

Payment and security

Payment is taken at checkout by card through Stripe, or through PayPal. Payments for Clearance Warehouse are collected by BuyFactory Direct Pty Ltd, the operator of Clearance Warehouse, which is owned by Caruso Consulting Co Ltd, so you will see Buy Factory Direct on the payment page and on your statement. We do not store your full card details.

Shipping, returns and cancellations

Delivery, returns, refunds and cancellations are set out in our Shipping and Refunds & Returns pages, which form part of these terms.

Limitation of liability

To the extent the law allows, and subject always to the Australian Consumer Law:

• we are not liable for indirect or consequential loss, or for loss of profit, data or opportunity, that was not reasonably foreseeable;
• we provide the website "as is" and do not promise it will always be available or free of errors.

Nothing in these terms excludes or limits any right or remedy you have under the Australian Consumer Law, or our liability for death or personal injury caused by negligence, or for fraud.

Governing law

These terms are governed by the laws of New South Wales, Australia. Your statutory rights as a consumer are not affected.

Changes to these terms

We may update these terms from time to time. The version on this page when you place an order is the version that applies to that order.
